Thank you for visiting the website for L&M Healthcare Communications, LLC (“the Company,” “we,” “us,” or “our”), maintained at www.lmhcare.com (the or our “Site”). The Company is committed to making sure that our users are aware of our practices regarding privacy and security. We want you to understand what information we collect from you, how we handle that information, and how you can contact us to correct any information that we may have collected.

CHANGES TO OUR PRIVACY POLICY

Any or all of our Privacy Policy may be changed at any time without notice being sent to you, in which event the revised Privacy Policy will be posted with an updated effective date. Your access or use of the Site after the posting of such changes shall mean that you accept such changes. Therefore, each time you use or access our Site, you should review the Privacy Policy.

BUSINESS TO BUSINESS SERVICE PROVIDER

The Company is a full-service medical communication agency that works with its clients in the biotechnology and pharmaceutical sectors to develop scientific communication programs that engage and educate professionals. Our products, services and our Site are not intended for individuals for their personal use. You should familiarize yourself with the terms of your organization’s agreement with the Company, as your misuse of our Site, products and/or services may expose you and your organization to liability.

Geographic Restrictions

The Site is based in the United States. Access to the Site may not be legal by certain persons outside of the United States. If you access the Site from outside of the United States, you do so on your own initiative and are responsible for compliance with local laws.

SCOPE

Our Privacy Policy guides our collection, storage, and use of information, including limited personally-identifiable and non-personally-identifiable information collected on the Site and through other electronic messages between you and our Site or you and the Company. By accessing the Site, you expressly consent and agree to the terms and conditions of our Privacy Policy, including the use and disclosure of your personal information in accordance with our Privacy Policy. PERSONALLY-IDENTIFIABLE INFORMATION OF CHILDREN AND INDIVIDUALS UNDER THE AGE OF 18

You agree that you are at least eighteen (18) years old, or the age of majority in your jurisdiction, and have agreed to OUR Privacy Policy.

The Site is not intended for children and individuals under the age of eighteen (18). The Company does not knowingly solicit or collect personally-identifiable information from children or individuals under the age of 18. If the Company knows that it has collected or received personal information from a child or individual under the age of 18, we will take reasonable measures to delete such information from our servers and databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required by law).

The Company only collects limited personally-identifiable and non-personally-identifiable information that is relevant for the purposes for which it is to be used, to the extent reasonably necessary for legitimate business purposes and in accordance with our Privacy Policy. The Company will take reasonable steps to ensure that personally-identifiable information is collected for purposes relevant to its intended use. If you or your organization choose to provide us with personally identifiable information, you or your organization consent to the transfer and storage of that information on our (or our third-party hosts’) servers.

Limited Personal Information

The only information we should receive from you, and which you should submit to us, through our Site, should be limited to 

  • your name,
  • company name,
  • company telephone number,
  • company email address, and/or
  • or other limited personally-identifiable information, which we may request from time to time.

We may collect both personal information and/or non-identifiable information on or through our Site from you. By way of example but not limitation, this includes information we collect

We collect limited personal information and/or non-identifiable information that you provide us. By way of example but not limitation, this includes

  • information provided through email, text message, and postal mailing list sign ups;
  • your responses to other surveys that we might ask you to complete for research purposes; and/or

If and when a standard for responding is established, we may revisit our policy on responding to these signals.

  • store information about your preferences, allowing us to customize our Site according to your individual interests;

Third Party Use of Cookies and Other Tracking Technologies

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

INFORMATION WE COLLECT FROM OTHER RESOURCES

If your company has a contract with us, we may be interacting with you pursuant to that business relationship, and you or your employer directed us to do so.  Please confer with your employer in this regard.

If you attended a conference that we conducted for one of our clients, we may have received your information from your registration for that event.  You would have been informed at the time of registration how your information would be collected and used.

If a company provided to us a list of persons to invite to an event, that company would have been responsible for how that information was gathered and used, and we rely upon our clients to do so responsibly and in compliance with laws.

HOW THE INFORMATION WE COLLECT FROM YOU IS USED

We use information that we collect about you or that you provide to us, which may include information and/or non-identifiable information. By way of example but not limitation, we use information

  • to fulfill or meet the reason you provided the information;

Notwithstanding the foregoing, the Company may share or disclose non-personally-identifiable information, whether aggregated or otherwise, with third parties.

Correction and Retention of Information

We strive to provide you with choices and control regarding your information. The Company retains the information you provide us as reasonably necessary in connection with the Company’s operation of its business and for you to use the Site, or for us to provide customer support or other services in connection with the Site. We will retain your information for as long as necessary to accomplish our purposes for such data.

You may send us an email at info@LMHCare.com to request correction and/or deletion of any personal information that you have provided to us.  Please note, however, that except in limited jurisdictions, business transactions and communications are not afforded privacy rights as are consumer transactions and related communications.  We will nevertheless endeavor to accommodate your requests.

We will, upon receiving your request, make reasonable efforts to correct, delete, and/or block your personal information from further use to the extent that it remains in our possession.

However, we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. Further, we may not be able to immediately delete your information while a pending request is not yet completed.

At the time your information is deleted, we will destroy your personal information using reasonable data-destruction practices.

If we have your information in relation to your company’s contract with us, you should confer with your employer regarding your requests, too.

Data Security

We have implemented reasonable measures designed with the intent to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we endeavor to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Site.

TO THE FULLEST EXTENT NOT PROHIBITED BY LAW, THE COMPANY DISCLAIMS AND SHALL HAVE NO LIABILITY FOR ANY LOSS OF, UNAUTHORIZED ACCESS OR DAMAGE TO, OR INTERCEPTION OF ANY OF YOUR INFORMATION BEING STORED ON OUR SERVERS OR ON THE SITE OR TRANSMITTED TO OR FROM THE SITE.

GOVERNING LAW; JURISDICTION; WAIVER OF JURY TRIAL

By using the Site, you agree that the laws of the State of New Jersey, without regard to principles of conflict of laws, will govern our Privacy Policy and any dispute of any sort that might arise between you and us, including, without limitation, any tort claims. Any such dispute shall be adjudicated in the federal and state courts in New Jersey, and you consent to exclusive jurisdiction and venue in such courts and waive any and all rights to claim inconvenient forum or immunity. You and we hereby expressly agree hereby, to the fullest extent permitted by law, to waive the right to a trial by jury.

BINDING AGREEMENT
